Daniel Pomeroy has been engaged in the private practice of law since 1982. After graduating magna cum laude from St. Michael’s College and with high honors from Seton Hall University School of Law, Mr. Pomeroy served as law clerk to the Honorable Robert L. Clifford, Associate Justice, Supreme Court of New Jersey. From 1982 through 1985, Mr. Pomeroy was an associate at the defense firm of Connell, Foley and Geiser prior to forming predecessor firm Mortenson and Pomeroy in October 1985. In 2012, he co-founded Pomeroy, Heller & Ley, LLC. Mr. Pomeroy is a fellow in both the American College of Trial Lawyers and the Foundation of the American Bar Association. He is also past president of the New Jersey Chapter of the American Board of Trial Advocates and past chairman of the New Jersey Defense Association Automobile Insurance Coverage Committee. Mr. Pomeroy has tried more than 135 jury cases for insurance companies and injured individuals. In addition, he has argued approximately 100 appeals, and has appeared before the Supreme Court of New Jersey on eight occasions.He is also the co-author of New Jersey Auto Insurance Law, presently in its 22nd edition. This treatise on automobile insurance law in New Jersey has been cited as “authoritative” in over 50 appellate decisions in the State of New Jersey. Mr. Pomeroy has lectured extensively to the judiciary, the bar, and the insurance industry on the practice areas described above.

Settlements achieved by Mr. Pomeroy, either as counsel or co-counsel for the plaintiff, include the following:

  • $10 million for anoxic brain injury following knee replacement surgery
  • $3.350 million for neurologic impairment caused by failure of emergency room physician to diagnose subdural hematoma
  • $2.9 million for post-operative visual loss (POVL) following pancreas transplant surgery
  • $2 million for failure to diagnose compartment syndrome following low leg fracture
  • $1.650 million for post-operative visual loss following gastric bypass surgery
  • $1.5 million for failure of emergency room physician to diagnose Acute Aortic Dissection, resulting in brain damage and death.
  • $750,000 for negligent administration of birth control pills resulting in pulmonary embolism and death
  • $750,000 for failure to diagnose emergency room myocardial infarction (heart attack)
  • $750,000 for death from hemorrhage during surgical procedure
  • $350,000 for negligent delay in diagnosing cancer
